Junk the Cybercrime Prevention Law!



Greetings,

We, the youth, journalists, activists, bloggers, and netizens of the Philippines express our outright condemnation to the passage of Republic Act No. 10175, or the Cybercrime Prevention Act of 2012, which poses serious threats to Internet freedom, the right to privacy and other essential civil liberties including the freedom of speech, expression, and the press.

While the Cybercrime Law was supposedly enacted to ward off hacking, identity theft, data manipulation, cybersex and other nefarious activities in the Internet, the insertion of provisions regarding online libel and vague sections on data collection and sanctions have transformed the legislation into an online censorship law.

We express our highest condemnation to the Bicameral Conference, especially to Sen. Vicente Sotto III, for inserting the online libel provisions, which are not present even in the 2001 Budapest Convention on Cybercrime penned by the Council of Europe, which was the basis for RA 10175.

The decriminalization of libel has been a longstanding legal battle in the Philippines, and the inclusion of online libel is a grave backward step. For years, various individuals have abused libel, a criminal offense in the country, to harass journalists, whistleblowers, and ordinary citizens. With the inclusion of online libel, we fear that all information we exchange in the Internet, even own personal communications, might be sanctioned and become grounds for criminal offenses.

We also fear the enactment of Section 19 of RA 10175, which effectively makes the Department of Justice an all-encompassing “Internet superpower.” Section 19 of RA 10175 states, “When a computer data is prima facie found to be in violation of the provisions of this Act, the DOJ shall issue an order to restrict or block access to such computer data.” Under such provision, the DOJ can take down websites that it suspects – upon initial observation – to be violating RA 10175.

The Cybercrime Prevention Law is, in fact, far worse than the “Stop Online Piracy Act” and the “Protect IP Act,” that were pushed in the US Congress earlier this year but failed to prosper. RA 10175 will have a “chilling impact” to bloggers, online journalists, advocacy groups and normal netizens, as any website can be shut down with accusations of infringement without due process.

It is also alarming that the new law was seemingly drafted with the mindset that crimes committed online is graver than those committed in the real world. Due to the vague provisions in RA 10175, even commenters and those that retweet libellous materials can also be incriminated.

As several provisions in this law are clearly unconstitutional, we strongly urge the government to junk this legislation and prevent the enactment of e-Martial Law. The passage of this law seemingly reflects the Aquino administration’s policy of neglect. This must be stopped, by all means.

With the government taking Internet freedom away, the Filipino people will not just stand and watch. Internet freedom is a human right, and we will defend it both in the virtual and the real world.

Waway's 10th Year Anniversary in YP


Today, August 26, exactly 10th year anniversary ko na sa YP. Pero katulad ng nalalaman ng iilan, ako po ang isa sa pinakamabait na member magmula pa noon.... Aking sasariwain sa inyo ang aking buhay YP...

Alipin ako noon ng Multiply at Friendster at doon talaga ako naglalagi, tumatambay at nagbabahagi ng saloobin at aking mga opinyon.



Ngunit isang araw, sa aking pag-iikot sa Cyberspace, may kung anung dumapo sa akin at napadpad ako sa site na kung saan ay magiging bahagi pala ng buhay ko ..... dyandyadyadyan!!!

4 Year Work Anniversary

Last August 1, 2012 is my fourth anniversary at my job, hindi pa ko regular pero i'm so happy sa mga nagawa ko at narating.... 

I'm the only outsourced personnel in the District na nakatravel sa 3 Port Management Offices sa loob ng 1 taon (2011).. Ako din ang first na nakapagtravel nang maapproved to sa contract.

Pitong Bagay Dapat Isaalang Alang sa Pagbblog!

Noon, pangarap kong makapagsulat sa mga magazines o newspaper. Sa School, ang nasasama lang sa editorial ng eskwelahan namin ay yung mga nagmuula sa Section 1... Para masabing isa kang manunulat, dapat nakatapos ka ng kursong Journalism o Broadcasting........ Noon yon.... ngayong panahon na ng Internet natupad din ang pangarap ko. Sa pamamagitan ng Blog o minsan,,, Social networking sites, nakakapagpahayag na ko ng mga gusto kong isulat.... gusto kong sabihin at gusto kong ibalita.

Kahit sino pwede ng maging writer sa sariing paraan pag dating sa internet. Pero may 7 bagay tayong dapat isaalang alang at dapat tandaan pagdating sa pagbblog.

I hate multiculturalism! I hate immigrants who have no respect for the local culture and customs. I hate people who don't want to speak the language of the country their in. I hate all of this "no more borders, the world is my home" bullshit that the far left cultural Marxists cry out. I hate corporatist Capitalism and big businesses for playing a role in the destructive damage done to cultures of the world. We're not really a third world country... Kasong Graft, Theft at Political Sabotage Parang Libel Lang

Ganito na ba talaga ang Justice System dito sa bansa? Yung Pandadaya sa Eleksyon may bail? Ayos ah.... parang Estafa Case lang..... Demokrasya ng Pilipinas ang ninakaw mo....... ano ba naman yan.... Weak evidence? Ilang tao na ba ang nagdawit sa pangalan nya... Ampatuan nga na kilalang kaalyansa nya, di pinayagan, Sya pa na Utak ng lahat?

Based on Article 310 in relations to Articles 308 and 309, No BAIL ang qualified theft if the value of the property is Php 32, 000 and above.... Eh eto, Demokrasya ng Pilipinas ang ninakaw, MERON???

Kaya no wonder din, na bakit ang mga foreigners (w/ tourist visa) or illegal entry or over-staying (like Pakistani, Chinese, Taiwanese, Koreans at Europeans pati na ang mga South Africans), e malalakas ang loob na gumawa ng crimes, illegal businesses at iba pang labag sa batas ng Pilipinas at ng Diyos. Kasi nga hindi lang sa mabagal ang justice sa ating bansa, pinalulusot pa. Patungan mo lang ng 'pera' si Juan Dela Cruz (public official or local official or government employee or ordinary citizen), or si Attorney Ewan Kolang. Ang mali ay itutuwid na niya!!!!!!!!!!

Sa Japan, pag napasok sa eskandalo ang mga matataas na opisyal, nagpapakamatay.... Salamat Po!
